    • Text-to-Video: Direct high-fidelity photorealistic video generation up to native 4K 60FPS from natural language prompts;
    • Image-to-Video: Dynamic cinematic sequences driven by single or multiple starting frames;
    • First & Last Keyframe Control: Precise keyframe specification for smooth transition sequences and directorial control;
    • Multimodal Reference Fusion: Synergy of up to 50 multimodal reference assets (characters, props, motion, lighting, and camera setups) in a single workflow;
    • 3D Cinematic Camera Motion: Pan, zoom, tilt, pedestal, arc, truck, and dynamic optical path trajectories;
    • Video Remix & Local Inpainting: Seamless subject, background, and prop substitution while preserving original motion velocity and lighting consistency;
  • Native Audio-Visual Synchronization: Automated frame-accurate environmental sound effects, Foley audio, and audio-visual sync;

Account Registration

1. Account Creation

When accessing our multimodal AI audiovisual generation services, you may need to create an account. You commit to providing accurate, complete, and up-to-date information. You are responsible for maintaining the security of your credentials, including protecting your password and preventing unauthorized access to your devices.

2. Account Responsibility

You are legally responsible for all activities that occur under your account, whether authorized by you or not. This includes all video render tasks, multimodal reference uploads, image generation requests, generated audiovisual assets, and credit consumption. If you suspect unauthorized access or security breaches, notify us immediately.

Conditions of Service Use

1. Lawful Use

You agree not to use our AI video and multimodal generation services for any unlawful, infringing, or unauthorized activities, including but not limited to:

  • Violating any applicable international, national, or regional laws and regulations
  • Infringing on third-party intellectual property, privacy, publicity, likeness, or moral rights
  • Generating video, audio, or images containing unlawful, violent, hateful, abusive, or harmful material
  • Generating non-consensual deepfakes, unauthorized facial replacement, or voice cloning of real persons
  • Producing deceptive disinformation to manipulate the public; proper AI disclosure must be provided when publishing synthetic media that could mislead viewers
  • Reverse engineering, decompiling, or attempting to extract proprietary AI model weights or backend APIs
  • Launching automated scripts, scrapers, or high-concurrency requests to disrupt GPU nodes or abuse free compute quotas

2. Content Restrictions

When utilizing our AI generation services, you strictly agree not to:

  • Generate content depicting child sexual abuse material (CSAM), non-consensual nudity, or explicit adult pornography
  • Create content promoting severe violence, terrorism, self-harm, hate speech, or discrimination against protected groups
  • Generate defamatory, harassing, or invasive synthetic media of real living individuals without consent
  • Create content that breaches data privacy laws or reveals confidential personal records
  • Generate media that infringes protected trademarks, commercial secrets, or copyrighted broadcast material
  • Produce fraudulent audiovisual schemes or deceptive scam media
  • Generate instructions or material promoting illegal weaponry, dangerous narcotics, or unlawful activities

3. Service Modifications and Termination

We reserve the right to modify, optimize, or discontinue any part of our services at any time, with or without prior notice. If you breach these Terms, we may suspend or terminate your account and freeze remaining credits. We bear no liability to you or any third party for service modifications or terminations.

4. Usage Limitations & GPU Compute Scheduling

Our multimodal generation platform relies on cloud GPU infrastructure and is subject to:

  • Daily or monthly credit allowances and concurrent job limits based on account tier (Free, Pro, or Enterprise)
  • Video duration caps (e.g., 5s, 10s, 30s limits per task) and frame-rate specifications
  • Video and image output resolution constraints (e.g., 720P, 1080P, Native 4K)
  • Rendering queue priority based on subscription plan
  • API and concurrency rate limits to preserve system health

Exceeding these limits requires waiting for reset cycles or upgrading to higher subscription tiers.

Payment and Credit Terms

1. Pricing and Subscription Plans

We offer diverse service plans for our multimodal AI audiovisual platform, covering varied concurrent rendering capacities, video duration allowances, resolution tiers, and compute credits. Subscription prices, included credits, and plan details are clearly presented on our website's pricing page. We reserve the right to modify pricing, with adjustments notified in advance to active subscribers and applied to future billing periods.

2. Payment Processing

Payments are securely settled via compliant third-party payment gateways (such as Stripe). You agree to provide valid billing information and authorize us or our processors to charge your selected payment method on recurring subscription intervals or one-time credit top-ups, including any applicable taxes.

3. Cancellation and Refund Policy

You may cancel automatic renewals at any time via your dashboard; cancellations take effect at the conclusion of the current billing cycle. Given that cloud GPU video rendering incurs real-time, non-recoverable infrastructure costs, subscription fees and consumed credits are generally non-refundable. For legally mandated refund approvals, refunds will deduct payment gateway transaction fees and may incur an 8% administrative handling fee. Unused promotional or subscription credits expire at the end of each billing cycle unless explicitly specified otherwise.

Intellectual Property & Content Rights

1. Platform Intellectual Property

All platform components of GeminiOmni, including but not limited to proprietary codebases, algorithm pipelines, UI designs, graphical assets, generative AI deep learning model weights, spatiotemporal diffusion architectures, and prompt optimization tools, are owned by us or our licensors and protected under international copyright and intellectual property treaties.

2. Your Generated Audiovisual Content (Video, Audio & Image)

For any media generated through the Service (including synthetic video sequences, images, audio effects, and prompt derivatives):

  • Ownership: Subject to compliance with these Terms and applicable laws, you retain full ownership and title to your generated media outputs
  • Commercial Usage Rights: Active paid subscribers receive a full commercial license, authorizing generated content for advertising, cinema, social media broadcasting, broadcast television, and commercial entertainment
  • Limited Technical License to Us: To render, preview, stream, synchronize, and archive your outputs, you grant us a worldwide, non-exclusive, royalty-free license strictly to process, host, cache, and transmit your assets within the Service
  • Community Gallery Feature: Only if you opt to publish your creations publicly in our community showcase or gallery do you grant us permission to exhibit and feature your media to fellow creators
  • Legal Compliance Warranty: You warrant that your generated media will not infringe on third-party publicity, defamation, or copyright laws in any relevant jurisdiction

3. Your Multimodal Input Material

Regarding prompts, reference pictures, first/last frame guides, and audio clips you upload:

  • Ownership: You retain full rights and ownership over all uploaded multimodal inputs
  • Processing License: You grant us the necessary license to use your inputs solely to execute AI inferences, composite sequences, and optimize service pipelines
  • Input Warranty: You warrant and guarantee that you hold valid rights or requisite licenses for any uploaded assets and that they do not infringe third-party rights

4. Creator Feedback

Any recommendations, technical bug reports, or feature ideas you submit to us may be implemented freely, perpetually, and without compensation or attribution obligations.

Nature of Generative AI & Disclaimers

1. Cutting-Edge Generative AI Technology

You acknowledge and agree that:

  • Cinema-grade AI video and audiovisual rendering relies on complex spatiotemporal diffusion models; outputs may vary depending on prompt nuance and reference assets, and the Service cannot guarantee that outputs will always fulfill subjective artistic expectations;
  • Complex kinetic movements, fast scene transitions, or extreme lighting conditions may occasionally exhibit minor artifacts, motion inconsistencies, or auditory micro-discrepancies;
  • AI models may coincidentally yield results that resemble existing real-world motifs; we make no exclusive warranty regarding trademark registrability or exclusive copyright monopoly over raw AI outputs.

2. Automated Content Moderation

To maintain a secure and compliant creative ecosystem, we reserve the right to:

  • Deploy multimodal safety classifiers to inspect prompts, reference visuals, and output video frames;
  • Intercept or take down generated assets that violate laws, public order, or these Terms;
  • Restrict, downgrade, or terminate accounts that persistently attempt to bypass safety guardrails.

Disclaimers

1. "As Is" and "As Available"

Our multimodal AI audiovisual generation services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, statutory, or implied. We do not warrant that service availability will be uninterrupted, latency-free, or completely devoid of transient software bugs.

2. Limitations of Output Warranties

We specifically disclaim warranties that:

  • Generated videos, pictures, or soundscapes will meet specific broadcast technical thresholds;
  • Rendered outputs will be entirely free of synthetic artifacts or auditory alignment variances;
  • Outputs will be completely immune from potential third-party intellectual property challenges (users are advised to conduct due diligence prior to enterprise commercial campaigns).

3. Third-Party Integrations

The Service may incorporate third-party cloud storage, foundation models, payment processors, or API integrations. We assume no responsibility for external third-party service continuity or third-party platform terms.

Limitation of Liability

  • Unscheduled cloud GPU maintenance, network connectivity failures, or force majeure events.

You agree to defend, indemnify, and hold harmless GeminiOmni from any third-party claims, liabilities, damages, regulatory penalties, and reasonable legal costs arising out of your violation of these Terms, unauthorized media distribution, copyright infringement, or misuse of the Service.

General Provisions

1. Entire Agreement

These Terms, together with our Privacy Policy, constitute the complete and exclusive legal agreement between you and GeminiOmni regarding the Service, superseding all prior written or oral agreements.

2. Modifications to Terms

We may update these Terms periodically to reflect product innovations or regulatory evolution. Revised Terms become effective immediately upon posting. Your continued use of the platform denotes binding acceptance of the updated Terms.

3. Severability

If any clause in these Terms is adjudicated unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions shall remain in full force.

4. Governing Law and Jurisdiction

These Terms are governed by and construed under the laws of the jurisdiction where GeminiOmni is registered, without regard to choice of law principles.
